Terms of Service

These Terms of Service ("Terms") govern your use of Vellcard ("Vellcard", "we", "us"), a digital business card service accessible at vellcard.com. By creating an account or using the service you agree to these Terms.

1. The Service

Vellcard lets you create and share a digital business card at a URL of the form vellcard.com/<handle>, with a themed layout, contact download (.vcf), and QR code. The service is offered on a Free plan (1 card, limited themes, Vellcard footer branding) and a paid Pro plan (unlimited cards, all themes, no branding).

2. Your account

You need an account to publish a card. You're responsible for keeping your password secure and for everything that happens under your account. Please give us a real email address so we can reach you about billing and security. One account per person; don't share credentials.

3. Your content

The name, contact details, links, and photo you put on your card ("Your Content") remain yours. By using Vellcard you grant us a worldwide, non-exclusive, royalty-free license to host, store, and display Your Content solely to operate the service — for example, to render your card's public page, generate its .vcf and QR code, and back it up.

You represent that you have the right to publish Your Content and that it does not infringe anyone else's rights.

4. Acceptable use

Don't use Vellcard to:

• Impersonate another person or misrepresent your identity.
• Publish content that is unlawful, harassing, hateful, sexually exploitative, or that infringes intellectual property.
• Distribute malware, phishing pages, or links intended to defraud visitors.
• Scrape or hammer the service, or attempt to disrupt it, bypass rate limits, or reverse-engineer its non-public parts.
• Use the service to send bulk unsolicited messages.

We may suspend or remove any account or card that violates these rules, usually with notice but immediately if the violation is serious.

5. Paid plans and billing

The Pro plan is billed monthly at $5/month (or another price we display at checkout). Payments are processed by Stripe; we don't see or store your card number. Your subscription renews automatically until you cancel. You can cancel any time from the billing portal linked in your account settings; cancellation stops future renewals but does not refund the current period. We don't issue partial-month refunds. If your card fails on renewal, we'll retry it a few times over about three weeks per Stripe's default schedule; if it keeps failing your account is downgraded to Free until you update payment.

We may change our prices; if we do, we'll give you at least 30 days' notice by email, and the new price applies at your next renewal.

6. Free plan

Free-plan cards display a small "Made with Vellcard" link in the footer. Please leave it in place — that's how we grow the service. Free plans are limited to one active card and a subset of themes.

7. Termination

You can delete your account at any time by emailing us; we'll remove your account and cards within 30 days. We may terminate or suspend your account for violations of these Terms, non-payment, or if we discontinue the service. On termination we'll keep backups of your data for up to 30 days for recovery and legal purposes, then delete them.

8. Disclaimers

Vellcard is provided "as is" and "as available". We don't guarantee that the service will be uninterrupted, error-free, or that any particular feature will remain available. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, Vellcard and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the service. Our total aggregate liability for any claim arising out of or related to the service is limited to the greater of $50 or the amount you paid us in the 12 months before the claim.

10. Indemnity

You agree to defend and indemnify Vellcard and its operator against any claim, damages, or expenses (including reasonable legal fees) arising from Your Content or your violation of these Terms.

11. Changes to these Terms

We may update these Terms from time to time. If a change is material, we'll notify you by email at least 30 days before it takes effect. Continuing to use the service after that means you accept the new Terms.

12. Governing law

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Denver County, Colorado, and you consent to their exclusive jurisdiction.
